PHP5 get_instance()

Would I be right in saying, you don't need to call the ci instance like =&
because PHP automatically passes by reference? Only in PHP4 should you do like this?

Yes, but since CI supports php4 it is common to add the =& .
Mind you this is depreciated in php5.3
