Please replace the 4 "//>" with ">" to make it more compliant. /> is reserved for XHTML, not HTML and may cause problems with HTML 4.01/Strict.

This does address an interesting point for HTML 5 adaption though. What is the plan for this batman?

In HTML 5 You can do both, not sure whether You can mix.

One should be able to globally set the doctype used and the form helper should read this setting and adjust its output accordingly.
