CodeIgniter v3 changes to OSL license?

I've read the long thread where everyone were discussing the change and made comparisons to GPL.
For us, OSL is much worse than GPL.
We are running an innovative startup and we register patents to protect our IP.
Should we move to CI 3, we can never file patent lawsuits all-round, even in conceptual matters not related to CI at all !
This is no-brainer, anyone who is registering patents (or plan to) can't use CI 3.
